By using Fast Estimate Maker, you agree to these terms. Please read them carefully.

Agreement to Our Legal Terms

We are Transform Agility Consulting, doing business as Fast Estimate Maker ("Company," "we," "us," "our").

We operate the website https://www.fastestimatemaker.com (the "Site"), as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services").

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Fast Estimate Maker, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Services from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Legal Terms. For material changes - including changes to pricing, data handling practices, or your rights and obligations - we will notify you by email at least fourteen (14) days before the changes take effect. For non-material changes, we will update the "Last updated" date and you waive any right to receive specific notice of each such change. Your continued use of the Services after the effective date of any revised Legal Terms constitutes your acceptance of those changes.

The Services are intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Legal Terms prior to you using the Services.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Services are not tailored to comply with industry-specific regulations (Health Insurance Portability and Accountability Act (HIPAA), Federal Information Security Management Act (FISMA), etc.), so if your interactions would be subjected to such laws, you may not use the Services. You may not use the Services in a way that would violate the Gramm-Leach-Bliley Act (GLBA).


2. Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics in the Services (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks").

Our Content and Marks are protected by copyright and trademark laws (and various other intellectual property rights and unfair competition laws) and treaties in the United States and around the world.

The Content and Marks are provided in or through the Services "AS IS" for your personal, non-commercial use or internal business purpose only.

Your Use of Our Services

Subject to your compliance with these Legal Terms, including the "PROHIBITED ACTIVITIES" section below, we grant you a non-exclusive, non-transferable, revocable license to:

Data Synced to Third-Party Platforms

If you connect a third-party service (such as QuickBooks Online, Wave Accounting, or Google Calendar), data that has been synced to that platform is governed by that platform's own terms of service and privacy policy once it leaves our systems. We do not retain copies of synced data beyond what is necessary for the sync operation. Disconnecting a third-party integration revokes our access to that platform, but data already synced is retained by the third party according to their policies.

Any breach of these Intellectual Property Rights will constitute a material breach and your right to use the Services will terminate immediately.

Your Submissions

By sending us any question, comment, suggestion, idea, feedback, or other information ("Submissions"), you assign to us all intellectual property rights in such Submission and agree we may use it freely for any lawful purpose without acknowledgment or compensation to you.

3. User Representations

By using the Services, you represent that:

  7. You will not use the Services for illegal purposes

You may need to register. You agree to keep your password confidential. We may remove or change usernames if we deem them inappropriate.

Phone Verification

As part of registration, you must verify your phone number via SMS. By providing your phone number, you:

Phone verification helps us prevent fraud, abuse, and ensures the integrity of our free trial system. We will not use your phone number for marketing purposes or share it with third parties for promotional use.

5. Purchases and Payment

We may limit or cancel orders.


6. Subscriptions

Billing and Renewal

Subscriptions continue and auto-renew unless canceled. Recurring charges occur without prior approval until canceled.

Free Trial

14-day free trial, then normal billing. Free trials require phone verification and are limited to one trial per phone number. Creating multiple accounts to obtain additional free trials is a violation of these Terms and may result in immediate account termination.

Cancellation

You may cancel your subscription at any time through your account Settings page. Cancellation takes effect at the end of your current billing period - you will retain access to paid features until then.

Refund Policy

Subscription fees are generally non-refundable. No prorated refunds are issued for partial billing periods, except as provided in Section 13 (Term and Termination). If you believe you were charged in error, contact [email protected] within thirty (30) days of the charge, and we will review your case. If the Services are materially unavailable for an extended period (more than 72 consecutive hours), you may request a prorated credit for the affected period by contacting support.

10. Third-Party Services and Integrations

The Services rely on and integrate with third-party platforms to deliver core functionality. By using the Services, you acknowledge that certain data may be transmitted to, processed by, or stored on the following third-party services. Each service is governed by its own terms of service and privacy policy, which we encourage you to review.

Payment Processing

Stripe - We use Stripe to process subscription payments and, if you choose to accept payments from your clients, to facilitate payment processing via Stripe Connect. Stripe receives your name, email address, and payment method details. We never store or have access to your full credit card number. Stripe is PCI DSS Level 1 certified. Square - If you choose to connect Square as an alternative payment processor, your OAuth credentials and payment data flow through Square's platform. Square is PCI DSS compliant. See Square's Terms of Service and Privacy Policy.

Accounting Integrations

QuickBooks Online (Intuit) - If you connect QuickBooks Online, we sync your client contact information (name, email, phone, address) and invoice data (line items, amounts, tax details) to your QuickBooks company file. You authorize this data transfer when you complete the OAuth connection flow. You may disconnect at any time, which immediately revokes our access. Data already synced to QuickBooks is governed by Intuit's Terms of Service and Privacy Statement.

Wave Accounting - If you connect Wave, we sync similar client contact and invoice data via Wave's API. You authorize this data transfer when you complete the OAuth connection flow. You may disconnect at any time. Data already synced to Wave is governed by Wave's Terms of Service and Privacy Policy.

You are responsible for ensuring that your use of connected accounting services complies with that platform's terms. We are not responsible for data handling by QuickBooks or Wave after data has been synced.

AI-Powered Features

Azure OpenAI Service (Microsoft) - We use AI to help extract job details from text, email, and voice input you provide. When you submit content for AI processing:

Email Delivery

Mailgun (Sinch) - We use Mailgun to send transactional emails (estimate deliveries, invoice deliveries, notifications) and to process inbound emails. Mailgun receives recipient email addresses and message content necessary for delivery. See Mailgun's Terms of Service and Privacy Policy.

SMS Delivery

Twilio (Twilio Inc.) - We use Twilio to send SMS verification codes, business notification texts about activity on your account, and, at your request, invoices and estimates via text message. Message and data rates may apply. See Twilio's Terms of Service and Privacy Policy.

Calendar Integration

Google Calendar - If you connect Google Calendar, we create calendar events containing client name, appointment time, address, and job description. You authorize this access through Google's OAuth flow and may disconnect at any time. See Google's Terms of Service and Privacy Policy.

Maps and Geocoding

Mapbox - We use Mapbox to render maps and convert client addresses into geographic coordinates. Addresses are transmitted to Mapbox for this purpose. See Mapbox's Terms of Service and Privacy Policy.

Authentication

Microsoft Entra External ID - If you sign up or log in using a social provider (Google, Facebook, or Apple), your authentication is handled by Microsoft's identity platform. We receive your name and email address from the social provider. We do not receive or store your social media password.

Analytics and Advertising

Google Analytics & Google Ads - We use Google Analytics to understand how our site is used and Google Ads to measure the effectiveness of our advertising. These services may set cookies subject to your consent preferences. See Google's Privacy Policy.

Meta (Facebook) Pixel - We use the Meta Pixel to measure advertising effectiveness. This service may set cookies subject to your consent preferences. See Meta's Privacy Policy.

Microsoft Clarity - We use Microsoft Clarity for heatmaps and session replays to understand how users interact with our site. Clarity may record mouse movements, clicks, and scroll behavior. This service respects your consent preferences. See Microsoft's Privacy Statement.

Bot Protection

Cloudflare Turnstile - We use Cloudflare Turnstile to protect against bots and automated abuse. See Cloudflare's Privacy Policy.

General Third-Party Disclaimer

We do not control, endorse, or assume responsibility for any third-party service, and are not liable for any loss or damage arising from their use, availability, outages, data handling, or policy changes. You access third-party services at your own risk. If a third-party integration experiences downtime, data loss, or a change in terms, we will make commercially reasonable efforts to notify you but are not responsible for any resulting disruption to your use of the Services.

13. Term and Termination

We may deny service, block IPs, terminate accounts, or delete content at any time for any reason.

If we terminate your account without cause (i.e., not due to a violation of these Legal Terms), you are entitled to a prorated refund of any prepaid subscription fees covering the unused portion of your current billing period. To request a refund, contact [email protected] within thirty (30) days of termination.

If terminated, you may not create a new account.


14. Modifications and Interruptions

We may modify, remove, suspend, or discontinue the Services at any time.

We are not liable for downtime or interruptions.


15. Governing Law

Texas law governs these Legal Terms.


16. Dispute Resolution

Arbitration

All disputes arising out of or relating to these Legal Terms or the Services shall be resolved by binding arbitration under AAA rules, except for: (a) disputes relating to intellectual property rights, (b) claims of theft or unauthorized access, (c) privacy violations, and (d) requests for injunctive or equitable relief.

No class-action arbitration.

We maintain certain data but are not liable for data loss or corruption.

Generated estimate documents may be stored temporarily (up to 48 hours) to enable sharing via QR code or link. These files are automatically deleted after expiration. We are not responsible for ensuring documents remain available beyond this period.

Customer Contact Information Retention: Personally identifiable information associated with your estimates—including client names, email addresses, phone numbers, mailing addresses, and job descriptions—is retained securely for the lifetime of your account. When you delete your account, all customer contact information is permanently deleted within 30 days.

Data Portability

You may export your data at any time in a machine-readable format (JSON) via the Settings page in your account. The export includes your business information, customer records, estimate data, invoice data, and CRM activity. If you request account deletion, you will have thirty (30) days to export your data before it is permanently removed. We support your right to data portability as provided by applicable law, including GDPR Article 20 and CCPA.


22. Electronic Communications, Transactions, and Signatures

You consent to electronic communications and signatures.

Electronic records satisfy legal requirements.
